Introduction
When determining a private rented tenant’s right and their landlord’s obligation there are two important questions:
1) Was a tenancy deposit paid;
2) Where the deposit obligations followed?
Depending on the answers it may afford a tenant a defence if the private landlord seeks possession as well as a money claim
